Overview

The Department of Transport and Planning has referred draft Pyrenees Planning Scheme Amendment C52pyrn (the draft Amendment) and unresolved submissions to the Flood-related Amendments Standing Advisory Committee (the Committee) for consideration and advice. This referral to the Committee has been made under delegation from the Minister for Planning at the request of Pyrenees Shire Council.

The draft Amendment proposes to implement flood modelling undertaken for local catchments within Pyrenees Shire, by applying flood controls to identified areas within the floodplains of Raglan, Upper Avoca, Upper Wimmera, Upper Mount Emu Creek and Waubra, as recommended by the five Council adopted flood studies being:

  • Raglan Flood Investigation (2020)
  • Upper Avoca Flood Study (2021)
  • Upper Wimmera Flood Investigation (2014)
  • Upper Mount Emu Creek Flood Investigation (2020)
  • Waubra Preliminary Flood Study (2019)

Legal Assistance Pilot Program

The Legal Assistance Service is a new 12-month pilot program for PPV hearings, offering no-cost or low-cost legal assistance to eligible submitters. The options for legal assistance can range from preliminary advice, review of documents and assistance with preparing submissions, and representation at a hearing. The scope of assistance and fee arrangements will be discussed directly with the barristers who will be engaged by direct brief.  Foley’s List is facilitating the pilot program.

The Legal Assistance Service aims to assist eligible participants in PPV processes. Foley’s List will discuss next steps directly with those who submit an enquiry form. Further information can be found on our Legal Assistance Service webpage.
